Operator and contact

The service

Sprytto lets you design, translate, publish and run a web store with content and a dashboard. Player purchases, prices shown by Tebex, payment processing and delivery of items into the game are provided by Tebex, which is the merchant of record. Sprytto is not a party to purchases between you and your players.

Accounts

You must be at least 18 years old and able to enter into contracts. Sprytto is intended for creators acting in the course of their business; if you are a consumer, the mandatory consumer protections of your country apply in addition to these Terms.

Keep your sign-in details secure, enable two-factor authentication and take responsibility for the members you invite to your workspace.

Plans, trial and payment

Every store has its own subscription to a Basic, Pro or Ultra plan, billed monthly or yearly at the prices shown on the pricing page. [Prices are stated including / excluding VAT.]

• The first store in a workspace may start with a 14-day trial. The trial requires a payment card and turns into a paid subscription automatically at its end unless you cancel before then.
• Subscriptions renew automatically for the same period until cancelled. You can cancel at any time in the dashboard; the store stays available until the end of the paid period.
• Plan changes take effect immediately and the price difference is settled on the next invoice.
• Payments are processed by Stripe. We never see your full card details.

Unpaid stores

If a payment fails or a subscription ends, the store goes offline and its dashboard becomes read-only. Seven days after payment stops the store and its content are erased permanently. You can pay or delete the store yourself at any time before that.

Refunds and withdrawal

Fees already paid are not refunded, except where the law requires otherwise. [If consumers can buy plans: consumers in the EU may withdraw within 14 days of concluding the contract; by starting to use a paid store during that period you agree that the service begins at once and a proportionate amount is charged if you withdraw.]

Acceptable use

You may not use Sprytto to:

• break the law or the rights of others, including intellectual property and consumer protection rules;
• violate the terms of Tebex or the rules of the game platform your server runs on, including their monetisation rules;
• distribute malware, phishing, spam or content that harms minors;
• try to break, overload or bypass the security of the service or other customers' stores;
• resell or sublicense the service without our written consent.

Your content

You keep all rights to the content you upload. You grant us the licence needed to host, process and display it in order to provide the service, and you confirm that you have the rights to use it.

Processing on your behalf

For personal data of your store's visitors we act as your processor under Article 28 GDPR. We process it only on your instructions given through the service; keep it confidential; secure it; use only the sub-processors listed in the Privacy Policy and inform you of changes in advance; help you answer data subjects' requests and meet your security and breach obligations; delete it when your store is erased; and provide the information needed to show compliance. The full data processing agreement is available on request.

Availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may carry out maintenance and improve or change features; we will announce changes that materially reduce the service in advance.

Suspension and termination

We may suspend or terminate an account or store for serious or repeated breaches of these Terms, for non-payment or where the law requires it. You can close your workspace at any time; before erasure you can export its data.

Liability

To the extent permitted by law, our total liability for any claim is limited to the fees you paid for the affected store in the 12 months before the claim, and we are not liable for lost profit, lost data or indirect damage. This does not limit liability that cannot be limited by law, including for intent or gross negligence.

Changes to these Terms

We will announce material changes at least 30 days in advance by e-mail or in the dashboard. If you do not agree, you can cancel before they take effect.

Governing law and disputes

These Terms are governed by Czech law and disputes are decided by the courts of the Czech Republic, without prejudice to the mandatory protection of consumers. Consumers can also turn to the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz) for out-of-court dispute resolution.
